These Terms & Conditions ("Terms") govern your use of the website hearthwisebudgeting.com and the household budgeting services provided by Hearthwise Budgeting. By accessing this website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

Hearthwise Budgeting provides household budgeting support, including budget setup, bill and subscription reviews, shared family goal planning, and ongoing budget coaching. Our services are educational and organisational in nature.

We do not provide regulated financial advice. Our services do not constitute investment advice, tax advice, pension advice, mortgage or credit advice, or any other service requiring authorisation under the Investment Intermediaries Act 1995, the Central Bank Acts, or any other financial services legislation in Ireland. We are not authorised by the Central Bank of Ireland to provide financial advice. If you require such advice, we recommend consulting a qualified and authorised financial advisor.

3. Eligibility and Client Responsibilities

To use our services, you must be at least 18 years of age and legally capable of entering into a binding contract under Irish law.

You agree to provide accurate, complete, and up-to-date information regarding your income, expenses, debts, and financial circumstances. You acknowledge that the quality and suitability of any budget plan depends significantly on the accuracy of the information you supply. You are responsible for the final decisions you make regarding your finances.

4. Consultations, Quotes, and Engagement

Initial consultations offered through this website are free of charge and without obligation. Following a consultation, we may provide a written quote outlining the services recommended, the applicable fees, and the expected timeline. A contract between you and Hearthwise Budgeting is formed only when you accept a quote in writing and payment arrangements are confirmed. Each engagement is governed by these Terms together with the specific terms set out in the accepted quote.

5. Fees and Payment

• One-time household budget setup services start at €149, as confirmed in your individual quote.
• Ongoing monthly budget coaching is charged at €49 per month unless otherwise stated in your quote.
• Unless otherwise agreed in writing, fees are payable in advance by bank transfer, debit card, or another agreed payment method.
• Fees are quoted in euro and are inclusive of VAT where applicable.
• Late payments may result in the suspension of services until outstanding amounts are settled.

6. Consumer Right of Withdrawal

If you are a consumer contracting with us within the European Union, and we deliver services entirely online without meeting you in person, you may have a statutory right to withdraw from the contract within 14 days of conclusion without giving a reason, in accordance with the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013.

If you expressly request that we begin providing services during the 14-day withdrawal period, you acknowledge that if the services are fully performed within that period at your express request, you lose the right to withdraw once the services are fully delivered. To withdraw, please notify us by email at info@hearthwisebudgeting.com, clearly stating your decision.

7. Cancellation and Refunds

You may cancel a scheduled coaching session with at least 24 hours' notice at no charge. Sessions cancelled with less than 24 hours' notice may be charged in full. For one-time budget setup services, refunds may be available on a pro-rata basis for work not yet commenced. Where monthly coaching is paid in advance, you may cancel the subscription at any time before the next billing date; fees already paid for the current month are non-refundable, as the service is delivered throughout the month.

8. No Guarantee of Financial Outcomes

While we are committed to helping you build a practical and sustainable budget, we do not guarantee any specific financial outcome, including debt reduction amounts, savings growth, or achievement of financial goals. Any figures or examples presented on our website, in testimonials, or during consultations are illustrative and depend on individual circumstances and your own actions. Testimonials reflect the genuine experiences of individual clients and are not indicative of typical or guaranteed results.

9. Intellectual Property

All content on this website, including text, graphics, logos, budget templates, worksheets, planning frameworks, and the Hearthwise Budgeting name and logo, is the property of Hearthwise Budgeting or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our materials without our prior written consent. Budget plans and templates prepared specifically for you are licensed to you for your personal, non-commercial use.

10. Acceptable Use

When using this website, you agree not to:

• Use the website for any unlawful or fraudulent purpose;
• Attempt to gain unauthorised access to the website, its servers, or related systems;
• Introduce malware, viruses, or other harmful material;
• Scrape, harvest, or systematically extract data from the website;
• Impersonate another person or misrepresent your affiliation with any entity.

We reserve the right to restrict or terminate access to the website for any user who breaches these provisions.

11. Confidentiality and Data Protection

We treat your personal and financial information as confidential. Any personal data you provide is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR) and the Data Protection Acts 1988–2018 of Ireland. You have the right to access, rectify, erase, restrict, or object to the processing of your personal data, and to data portability. To the fullest extent permitted by Irish law, Hearthwise Budgeting shall not be liable for any indirect, incidental, special, or consequential losses, including loss of income, loss of savings opportunities, or financial hardship arising from decisions you make based on our guidance or plans. Our total aggregate liability for any claim arising from our services shall not exceed the total fees paid by you to Hearthwise Budgeting in the three months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

13. Consumer Statutory Rights

If you are a consumer, you have statutory rights under Irish consumer protection law, including the Sale of Goods and Supply of Services Act 1980, which requires that services be provided with due skill and care. Nothing in these Terms affects your statutory consumer rights, which cannot be excluded.

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, illness, government actions, utility failures, or other events of force majeure.

15. Amendments to These Terms

We may update these Terms from time to time. The current version will always be published on this page with an updated revision date. Where changes are material and affect an ongoing engagement, we will notify you in advance by email. Continued use of the website or services after changes take effect constitutes acceptance of the revised Terms.

16. Termination

Either party may terminate an ongoing coaching engagement with 14 days' written notice. We reserve the right to terminate services immediately if you materially breach these Terms, provide persistently inaccurate information, or engage in abusive conduct toward our staff.

17. Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with them are governed by the laws of Ireland. The courts of Ireland shall have exclusive jurisdiction over any disputes. If you are a consumer residing in the European Union, you may also benefit from mandatory protections available in your country of residence.
